Overview of the Department

Trade constitutes a key and highly productive sub sector of the Kenyan economy. It has strong linkages with other sectors of the economy and contributes towards employment and wealth creation.

It contributes significantly to the Kenyan Gross Domestic Product (GDP) through promotion of domestic and international trade. The sector plays a crucial role towards the attainment of National Development Objectives and the Millennium Development Goal 1 which focuses on eradication of extreme poverty and hunger and Goal 8 on development of global partnerships for sustainable development.

The Department is headed by a Director and has three Divisions at the Headquarters namely: Business Support Services; Trade Monitoring & Research; and Trade Policy and East African Matters. The Department also has a representation at county levels. Presently there are 50 Trade Development Offices covering all the 47 counties.

Trade & Industry

Weights & Measures

Mandate

Fair trading practices and consumer protection.

Mandate developed from the enforcement of the weights and measures Act, Cap 513 and the Trade Descriptions Act, Cap 505, Laws of Kenya and any other subsidiary legislations developed by the cabinet secretary concerned from time to time.

Functions

  • Formulation, review and implementation of policies and registration of weights and measures and other consumer protection services.
  • Promotion of uniformity of all measurements in trade through procurement and maintenance of physical standards of weights and measures, which are nationally and internationally recognized.
  • Control of the accuracy and manner of use of weighing and measuring equipment in use for trade
  • Control of the sale of goods in terms of quantity i.e. weight, measure or number of such goods as laid down in the regulations.
  • Protection of the consumer against cheating through false description of goods and services in terms of quantity, quality, price, composition, fitness for purpose, place
    • or date of manufacture or such other practices.
    • Regulation of sale, manufacturing and repair of weighing and measuring equipment for use for trade.

Objectives

The strategic objectives of the department are to:-

  • Continuously, maintain accurate working standards of weights and measures for use in checking the accuracy of all weighing and measuring equipments in use for trade;
  • Ensuring fairness in trade transactions involving quantity measurements through regular checks of all weights, measures, weighing and measuring instruments in use for trade and inspection of all trading premises and factories, at least once a year;
  • Continuously ensure all new types or patterns of weighing and measuring equipments intended for use for trade conform to the specifications laid down in the weights and measures Act, Cap 513 and that the equipment is not a type which could be easily manipulated or altered to permit fraudulent use in trade.
  • Regularly monitor the performance of all persons engaging in the manufacture, repair, and assembly or overhauling of weighing and measuring equipments for trade use to ensure that all required standards of accuracy are maintained.
  • Regularly monitor all advertisements in the media to monitor false description of goods and services as a means of enticing the consumer to buy such goods or service.

Tourism

Mandate

The Directorate is charged with the responsibility of developing, maintaining and regulating the tourism industry, in conjunction with the other stakeholders.

Core Functions

  • Planning and Policy-making: Overall tourism policy formulation, implementation, monitoring and review in collaboration with stakeholders.
  • Overall Co-ordination: Liaise and coordinate with international, regional and local institutions on tourism issues.
  • Resource Mobilization:  Internal and external resource mobilization in consultation with the Treasury for the development of tourism.
  • Facilitation:  Establishment of an enabling legal and regulatory framework, promotion of local and foreign investments, safety and security of tourists, and conservation of biodiversity.
  • Marketing:  Undertaking and facilitating of domestic and international tourism marketing activities in collaboration with stakeholders.
  • Regulation and Monitoring:  Setting standards for hotels and restaurants and regulating tourism enterprises with oversight authority in all tourism issues.
  • Code of Practice:  Collaborating with stakeholders in establishment and enforcement of codes of practice for tourism at all levels benchmarked on internationally accepted standards
  • Product Development and Diversification:  Development of viable tourism products and promotion and community participation in tourism.
  • Capacity Development:  Coordinating capacity development and setting of standards in the hospitality industry.
  • Research and Development:  Undertake and coordinate research in the sector.

Industry

  • Industrial Property Rights Policy for the protection and use of industrial property,

  • Promotion of the development of industrial tooling and machining,
  • Facilitation of the development of technical, entrepreneurial and managerial skills for the industrial sector and
  • Arbitration and settlement of Industrial Property Rights Dispute.
  • Promotion of Industrial Research and Development, Innovation, and Technology Transfer,
  • Creation and Promotion of market linkages for Micro, Small and medium Industries(MSMIs)and
  • Facilitation of access to short, medium and long-term financing for MSMIs.
